Breach and Remedies

If you breach these Terms of Service: Plastics Postings reserves the right to immediately terminate your account and access to our services without refund. We may retain all fees you have paid and may charge reasonable cancellation costs. We also reserve the right to pursue any legal remedies available under applicable law, including seeking damages for any harm caused to our business or reputation.

If Plastics Postings breaches these Terms of Service: Your exclusive remedies shall be limited to either: (1) a reasonable price reduction proportionate to the nature of the breach, or (2) pursuing resolution through the dispute resolution process detailed in the “Governing Law, Severability, Dispute Resolution, Venue and Class Action Waiver” section below. You agree that these are your sole and exclusive remedies for any breach by Plastics Postings, and you waive all other potential remedies that might otherwise be available.

Account Registration and Obligations

This Website and its services are intended solely for plastics manufacturing companies and professionals directly employed by such companies. Recruiting firms, staffing agencies, and other third-party hiring intermediaries are not eligible to register for or use our services. By creating an account, you represent and warrant that you are either a plastics manufacturing company or a professional directly employed by such a company, and not a recruiting firm or similar intermediary.

Eligibility: You must be at least 18 years of age and located within the United States to use our Services. Users outside of the U.S. are prohibited from creating accounts or using the Website.
Account Security: You are responsible for maintaining the confidentiality of your account credentials, including your username and password. Any activities occurring under your account are your responsibility.
Accurate Information: You agree to provide and maintain accurate, truthful, and up-to-date account information. Providing false or misleading information may result in account suspension or termination.
Account Closure: You may close your account at any time by contacting us at info@plasticspostings.com. Upon account closure, your profile will no longer be visible to other users, though some information may remain in our systems for a reasonable period as required for legal, security, or technical purposes.
Termination: We reserve the right to suspend or terminate accounts that violate this Agreement, engage in fraudulent activities, or disrupt the Website’s integrity.

Terms and Conditions for Companies

These terms and conditions (“Terms”) govern all Companies (defined as “Company”, “you” and “your”) that:

have created an account on Plastics Postings;
have been advised that information submitted will be stored on your behalf within Plastics Postings’ Company Accounts; and
have utilized any features of the Site or Plastics Postings’ Products offered through the Site.

Once access to the Company Accounts has been granted to you by Plastics Postings, the Company will have access to the Company Accounts and the functionality therein, unless such access is terminated by us in accordance with these Terms and/or the Terms of Use.

If your access to the Company Accounts is terminated for reasons other than fraud or dishonest conduct on your part, Plastics Postings will, if requested, within 20 Business Days, forward all associated information stored on your behalf to your nominated email address.

Your access to the Company Accounts (and the functionality contained therein) will be via a secure login username and password set by you for use on Plastics Postings (the Password). The Company is responsible for:

providing Plastics Postings with the identity and contact details of individuals authorized to access the Company Accounts on your behalf (authorized users);
supervising the use of the Company Accounts by the authorized users, and ensuring that such use is consistent with the guidelines outlined under the heading ‘Use of Company Accounts’; and
ensuring that any Password provided to authorized users is kept secure and confidential.

You are responsible for the strength of the Password used on Plastics Postings to enable users to gain access to the Company Accounts, whether the use is by authorized users or any other person. Any act or omission by an authorized user in respect of the use of the Password and/or the use of the Company Accounts that breaches these Terms will be deemed a breach of these Terms by you.

Use of Company Accounts

You agree that you will:

Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements;
Provide accurate information to us and keep it updated;
Use your real company name on your profile; and
Use the Services in a professional manner.

You agree that you will not:

Create a false identity on Plastics Postings, misrepresent your identity, create a company profile for anyone other than your legitimate plastics manufacturing business;
Register or use our Services if you are a recruiting firm, staffing agency, or other third-party hiring intermediary, as our platform is exclusively for plastics manufacturing companies;
Develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services;
Override any security feature or bypass or circumvent any access controls or use limits of the Service;
Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties without the consent of Plastics Postings;
Disclose information that you do not have the consent to disclose (such as confidential information of others);
Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights;
Violate the intellectual property or other rights of Plastics Postings;
Post anything that contains software viruses, worms, or any other harmful code;
Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology;
Imply or state that you are affiliated with or endorsed by Plastics Postings without our express consent;
Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without Plastics Postings’ consent;
Use bots or other automated methods to access the Services, add or download contacts, or send messages;
Monitor the Services’ availability, performance or functionality for any competitive purpose;
Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services;
Overlay or otherwise modify the Services or their appearance;
Interfere with the operation of, or place an unreasonable load on, the Services;
and/or Violate any additional terms concerning a specific Service that are provided when you sign up for or start using such Service.

Companies are solely responsible for any modifications, edits, or deletions they make to content within our services, including but not limited to job listings and company profiles. Plastics Postings provides tools and features that allow for the creation, editing, and deletion of content by users at their discretion.

Plastics Postings is not obligated to restore or reconstruct original versions of content once they have been altered or deleted by the user.

Terms and Conditions for Job Seekers

These terms and conditions (“Terms”) govern all Job Seekers (defined as “Job Seeker”, “you” and “your”) that:

have created an account on Plastics Postings;
have been advised that information submitted will be stored on your behalf within Plastics Postings’ Job Seeker Accounts; and
have utilized any features of the Site or Plastics Postings’ Products offered through the Site.

Once access to the Job Seeker Accounts has been granted to you by Plastics Postings, the Job Seeker will have access to the Job Seeker Accounts and the functionality therein, unless such access is terminated by us in accordance with these Terms and/or the Terms of Use.

If your access to the Job Seeker Accounts is terminated for reasons other than fraud or dishonest conduct on your part, Plastics Postings will, if requested, within 20 Business Days, forward all associated information stored on your behalf to your nominated email address.

Your access to the Job Seeker Accounts (and the functionality contained therein) will be via a secure login username and password set by you for use on Plastics Postings (the Password). The Job Seeker is responsible for:

ensuring that any Password is kept secure and confidential;
all activities that occur under your account; and
notifying Plastics Postings immediately of any unauthorized use of your account or any other breach of security.

Use of Job Seeker Accounts

You agree that you will:

Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements;
Provide accurate information to us and keep it updated;
Use your real name on your profile; and
Use the Services in a professional manner.

You agree that you will not:

Create a false identity on Plastics Postings, misrepresent your identity, create a Member profile for anyone other than yourself (a real person), or use or attempt to use another’s account;
Register or use our Services if you are acting on behalf of a recruiting firm, staffing agency, or other third-party hiring intermediary, as our platform is exclusively for direct employment in the plastics manufacturing industry;
Develop, support or use software, devices, scripts, robots or any other means or processes to scrape the Services or otherwise copy profiles and other data from the Services;
Override any security feature or bypass or circumvent any access controls or use limits of the Service;
Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties without the consent of Plastics Postings;
Disclose information that you do not have the consent to disclose (such as confidential information of others (including your employer));
Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights;
Violate the intellectual property or other rights of Plastics Postings;
Post anything that contains software viruses, worms, or any other harmful code;
Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology;

Plastics Postings provides tools and features that allow for the creation, editing, and deletion of content by users at their discretion.

Plastics Postings is not obligated to restore or reconstruct original versions of content once they have been altered or deleted by the user.

Purchases, Subscriptions, and Payment Terms

Purchases, Subscriptions, and Payment Terms

Pricing & Offers: We offer various services that users can purchase through our Website. Pricing is determined based on the specific needs of the user. While we provide basic service packages that may suit some businesses, larger organizations may require custom enterprise solutions. For such cases, users should contact our sales team for personalized pricing and custom quotes. All prices provided do not include applicable taxes or additional fees.
Payment Processing: Payments are processed through Stripe, a third-party payment processor. Accepted payment methods include Visa, MasterCard, American Express, and Discover. We also offer direct invoicing for customers who prefer to pay via invoice, including those utilizing Purchase Orders (POs).
Subscriptions & Automatic Renewal: Certain Services may be offered on a subscription basis. Subscriptions will automatically renew unless canceled prior to the renewal date. Users may cancel their subscriptions through their account settings or by contacting us. Users will retain access to the subscription benefits until the end of the current billing cycle.
Refund Policy: Users may request a refund within 7 days of purchase by contacting our support team. Refunds will be granted at our discretion.

Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the state of Pennsylvania, United States, without regard to its conflict of laws provisions. These terms shall not be governed by the United Nations convention on contracts for the sale of international goods, the Uniform Commercial Code, nor Incoterms.
